This licence statement constitutes a legal agreement ("licence Agreement") between you (either as an individual or a single entity) and Smartphoneware - software developing company ("Smartphoneware") for the software product ("Software") identified above, including any software, media, and accompanying on-line or printed documentation.

BY INSTALLING, COPYING, OR OTHERWISE USING THE SOFTWARE, YOU AGREE TO BE BOUND BY ALL OF THE TERMS AND CONDITIONS OF THE LICENSE AGREEMENT.

If you have upgraded version of the Software, you may use or transfer the upgrade version of the Software only in accordance with the license Agreement.

Any use of the program which is illegal under international or local law is forbidden by this licence. Any such action is the sole responsibility of the person committing the action.

You may not distribute, copy, emulate, clone, rent, lease and sell the program. Also, you may not modify, decompile, disassemble, otherwise reverse engineer, or transfer the program, or any subset of the program, except to the extent and for the express purposes authorized by applicable law. Any such unauthorised use shall result in immediate and automatic termination of this licence and may result in criminal or civil prosecution.

The program is distributed "AS IS" and you assume full responsibility for determining the suitability of the program and for results obtained.

Smartphoneware makes no warranty that all errors have been or can be eliminated from the program software and, with respect thereto, Smartphoneware shall not be responsible for losses, damages, costs, or expenses of any kind resulting from using or misusing the program including without limitation, any liability for business expenses, machine downtime, damages experienced by you or any third person as a result of any deficiency, defect, bug, error or malfunction. Smartphoneware shall not be liable for any indirect, special, incidental, or consequential damages relating to or arising out of the subject matter of this Agreement or actions taken thereunder

NO WARRANTY OF ANY KIND IS EXPRESSED OR IMPLIED. YOU USE THE PROGRAM AT YOUR OWN RISK. SMARTPHONEWARE DISCLAIMS ALL WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. NOBODY WILL BE LIABLE FOR DATA LOSS, DAMAGES, LOSS OF PROFITS OR ANY OTHER KIND OF LOSS WHILE USING OR MISUSING THIS SOFTWARE.

Our registration mechanism allows to use the application on one target device only. If you have upgraded your device on next generation device e.g. from SonyEriccson P800 to SonyEriccson P990 you need to acquire a new license to continue using the application. As a registered user the best way to get the new license is to log in to our Online customer care system and click "Device change" button near the product order. You will be given 50% or even 70% discount when purchasing the new license (depends on how long ago you have purchased your previous license). If your device was broken and changed by the service center on the same device please write our sales department with explanation of this problem to get the new license information for your new device for free of charge.

If you do not agree with the terms of this licence you must remove Software files from your storage devices and cease to use the Software.
